    hell, any body know for f3 , which forms we have to fill? I know they are going to send us, but I think filling them sooner is helpful. I know only about DS230 that we, as beneficiary should fill and the i864 that the petitioner should fill. Do you know more? thanks

    eniamrahc :Hi Shelee,
    My PD is July 6, 2006.. I was 19 yrs 11 months that time.. My visa petition was granted last April 22, 2009 and right now I’m 22 yrs 10 months old.. My mother is a permanent resident..
    In CSPA the computation is VISA NO. AVAILABILITY – BIRTHDATE (A)VISA APPLICATION DATE – VISA APPROVAL DATE (B)THEN A MINUS B
    Does the DATE of visa number availability affect my chance of getting my petition fully approved? If my 1-130 is already approved, and i am only waiting for my visa no., will it still have a chance to be rejected if the visa no. waiting time becomes too long? Isnt it their fault then that it takes too long for us to be issued the visa number? it will be so unfair on my part.
    thanks a lot to anybody else as well who can share their knowledge regarding this..

    u will still be in f2a. I am in the same situation. can i have ur chat id. i am very bored that iam on my own now. it’s almost 3 years since my parents filed me the petition

    Future immigrants,

    I have been reading your posts for sometime and have also posted few of my own but I think we need to add up what has already been posted here to better understand what PDs are getting appointments or receiving the first batch of forms. So I appreciate if the new moderator could help out to make a simple table for us to input our PDs and what is going on with our applications. If people agree with me, please let the moderator know that we do appreciate his input to help us make sense of all these postings in one glance. I do not mean anything like Trackitt, but simple 3-4 columns to make us see where we stand in this immigration process quagmire.

    May 22nd, 2009 at 06:36 | #16

    TO All F3 and Chita: Cut-off dates have never gone backward. It can either stop or go forward? I absolutely do not understand what Chita means by saying that? Besides after the long time that F3 experienced a very slow movement, it is about 2, 3 months it is going smoothly. I somehow shows that the ball is rolling and we can expect good movement in the upcoming months.

  17. mt2644
    May 22nd, 2009 at 09:12 | #17

    Hello Chita,
    Don’t worry about the cut off dates so much. I am sure they will move forward and you will get your call for visa interview in no time. I am in f3 with Sep 2001 PD and if all goes well, like it has, I may get the call for next summer.

    I do not want to be a drag but Pooyan, the dates have gone backward few times in the past 8 years however I doubt that they may act the same way this year, due to better all around coordinations among different offices involved with immigration services, I read about few weeks back.

    To Rose,
    Child Status Protection Act (CSPA) is something that you need to look in to. I am not sure if it does apply to your case but it is the only thing I could think of.

    If all fails, I would get him a student visa since he is only 21 and needs to go to collage no matter how he intends to move to US.

  34. mt2644
    May 26th, 2009 at 04:12 | #34

    @rose
    this is what was said on Ron Gotcher’s blog”The Child Status Protection Act tolls the aging of a dependent child during the time the petition is pending. To see if you are still considered a minor, take the time the petition was pending and (the time between filing and approval) and add that to 21 years. If the new total is higher than your age, then you are still a “minor” for visa purposes.”

    thanks a lot for your info, the pending date for us is 402 days and my son is nearly 21 now . if this is true he still has enough time. though I heard that , this kind of calculation is for the f1 and f2 . But hopefully that applies to my son too who is “Derivative Beneficiaries” meaning the son of the applicant.
    you gave me hope
    thanks a lot

    Dear Pooyan,
    yes it has been a long time waiting for this. My parents and almost all close relatives are living in the US for more than 15 years now and as I am married I am in F3 section and now worried for my son who is in Oxford university and nearly 21. If my son can not be given visa with us may be he can get the student visa, later on . we are all separate in different countries .
    Take care of yourself and let me know more about yourself. I will definitely let others in this site know when I receive the letters from the Visa Center of embassy my PD is Nov20 2000. Good luck

    @Parvez
    Parvez, tell us more aboout yourself. what was your Priority date and in which category you are? I thought after the interview, if all the documents are ready they will issue visa immidiately. what was the problem?

  42. Pooyan
    May 26th, 2009 at 14:41 | #42

    Dear Rose, I have somehow the same situation. My parents and my brother and lots of my relatives are living in USA. When my parents applied for me I was single. In the middle of my process I got married. That changed my category to F3 instead of F1. All my letters came from the NVC, because at that time they were not aware of my marriage. Anyhow, we let them know and I changed my category. I started studying in Cyprus. This semester I am graduating from Master and I really do not have anything to do. I really can not start my PHD in here, because PHD will not take a year or two. It’s definitely more than that. Therefore I’m badly waiting to receive the letter from NVC. I’m hopeful anyhow. About your son, I’m not sure, but as far as the NVC is concerned, I think they do not issue visa for children of age 21 and older. Therefore, I recommend you not apply for him, because if you do you are in fact closing all other doors to him to enter USA. The base choice would be getting an ADMISSION from a good university in USA and get a student visa. There are some ways he can change the visa type and get the green card there. By the way, do not wait until you get your green card. Let him apply for his student visa just right now, if you are sure he will be more than 21 years of age at the time of interview. Take care. Keep in touch.

    hi rose i dont know if this is bad or good news but i received a email from the national visa center after i have written to them asking about the status of my application i received this letter and it read thus
    this case is currently under review for applicability of child status act {CSPA}. you will be notified as soon as a decision is made. please be adviced that there is no time frame for when this will happen . remember that i say that my daughter was age out ie she is twenty two year. i am not sure what the nvc is saying because my pd date is nov 24 2000 seeing that the nvc is saying that there is no time frame does that mean that even when my pd date has come that the nvc will not process my visa because they are still reviewing my file can some one clarify this for me
