D. EXPIRATION OF TWO EMPLOYMENT VISA CATEGORIES

Employment Fourth Preference Certain Religious Workers:

Pursuant to Section 2(a) of the Special Immigrant Nonminister Religious Worker Program Act (Pub. L. 110-391), the nonminister special immigrant program expires on March 6, 2009.

Employment Fifth Preference Pilot Program Categories (I5, R5):

Pursuant to Section 144 of the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (Public Law 110-329), the immigrant investor pilot program expires on March 6, 2009.

The cut-off dates for the above categories are shown as “Unavailable” for April. Congress is considering an extension for each of these categories, but there is no certainty when such legislative action may occur. If legislation to extend either of these categories is enacted, the cut-off date for that category would immediately become “Current.”

    hi, i was petitioned by my brother in 1983 together with my husband and 2 elder children .We are now residing in Iran, when the petition was approved in 1989 i was informed by my family in the Phil. due to one reason or another we were not able to reply to the letters the US embassy were sending to my Phil. address.When finally I visited the Phil. and ask my brother there about the letter he said it is already cancelled due to non repliance. Now my children are grown ups and would like to immigrate to the US. Do you think there is anyway of reactivating this petition?Thank you.

    Robin, hello. My priority date is Feb. 15, 20001; that is 5 months and 23 days from today for my case to become current. But as we all know, this is not the case and the movement of cases specially f3 is much slower than what we expect. Anyhow, I would like to ask you if you have received those letters, which are actually the final ones from the VISA CENTER or not? I have heard when you have something like 6 months for your case to become current, you will receive some letters to finalize your case. If you have received could you please tell me how much time was left for your case to become current the day your received your letters? By the way, as far as I know, when your case becomes current, you will have something like 5, 6 months of paper work to get to the appointement in the embassy. Afterwards you have to wait for your FBI check, which can formaly take between 6 weeks to one year.

    Has anyone got an Idea whats the situation with Eb3? Last month i think it was May 2005. Seems like they went back instead of moving forward??? May 2003. anyone has any update plz add . I will appreciate that. thanks

    My PD is Oct 5, 2000 on F3.
    Documents already sent!
    Affidavit sent!
    Fee payments Done!
    I think NVC sends the medical exam request like a month before the date of the interview. Lets hope it moves quickly!! Is any one doing medical exams?? Good luck to all of us!!

    Good day,my mom petition us under F3 and our pd is nov 1993. my children are now 25 and 21 now. can they still go with us in case our pd become current? im from the philippines.

    Mina, unfortunately there is no way to reactive your file. Once you did not reply, it was considered abandoned and closed.

    Penelope, it will be another 2-3 years before your PD becomes current. There is a possibility that your children can come with you. Generally, a child in a case like yours (a derivative beneficiary) may not immigrate with the beneficiary parent if they are 21 years or older. However, the Child Status Protection Act offers some relief. You need to know how long it took USCIS (formerly INS) to approve your I-130; the time your mother filed and when it was sent to the National Visa Center (NVC). You or your mom should have received this information from the NVC. That time is not counted against your children. So if it took four years, then for CSPA, your child who is now 21 years old is considered 17. In 3 years, the child’s CSPA age will be 20 and he/she will be able to immigrate with you. The other child will not be helped because that child CSPA age is now 21 and in 3 years it will be 24.

    My family based 4 petition was transferred to the National Benefits Center (NSB) in Missouri for additional processing. It is an I130 petition, is there anyone out there in the same position? When checking the processing times for NSB there is no reference to I130.

    Hello Pooyan,
    My first notification for selection of choice of agent was on Nov. 15 2008. Once selected Agent, fee for affidavit was requested on december 9th 2008. Once payment was done, you sent affidavit forms along with the cover sheet that allows you to do so. The I recieve the request for Application DS230 fee payment. Once I paid I sent proper translated documents, forms, photographs and cover sheet. That was like 3 weeks ago. Getting documents a trabslation takes time in my country. I was requested other documents to support affidavit and already sent them last week. So I´m waiting for next steps. I believe you will start all this process when PD is by december 2000. Thats only my guess! Hope its less of course! Good Luck!!!

    what is going on with employment base visa.for the last three month they
    have been working mar 2003 cases.starting april they will see mar 2001
    cases.they going backword.do you guys have any idea?

    hey JC do u know till which dates all paperwork or documents work have been finished……….if it is in huge numbers then the f3 will move fast bcoz they cannot now pile up the files…so please try to find out this……..reply me back

    How much time we should wait if our categorie is F3 and PD sept 5, 2000 and we live Charge- ability Areas that cut of date is august 22, 2000.
    Anyone can reply if only he knows how long it will take.

    hello, i just want to ask if i will have a chance to visit my mom in US. even im under petition by her? im F3 with pd nov 93 philippines. im thinking of going there for a visit. but some says that if i do that i might ruin my petition. consul will not allow me to go to US and have to wait for my petition to be current. thanks and more power!

    Can anyone help this matter i.e. my PD 20feb 2006 and My attorney filed
    I-485 And its recieving Date is 18Aug2007 Nebraska….i m confused between Attorney and other resources. Attorney said look PD on visa bulletin i have approved i-140, but some or many people said visa bulletin just for applying I-485 after that you can check by USCIS processing time ,,,,please clear this confusion what I look , Visa Bulletin or Processing Time from USCIS… i wll be glad All of you….

    actually it was almost december 2008 when my attorney received my “affidavit of support” and “ds-230″ forms. i filled them in and sent back to NVC a week later.

    Hi Robin, i’ve a few questions: my laywer filed for an I140 and receiving date is Feb. 17, 2009.
    - Is this my priority date? the one I check in the visa bulletin?
    - Can he also file for an I485 already or do I have to wait until Feb. 17, 2009 becomes current?
    - is it possible for me to travel to the US for a vacation (i have a tourist visa) even if I have an application for I-140? I have no intention to stay past the given allowed time as I don’t want to ruin my chances of getting approved
    - I received an automated update requesting for further evidence, im nervous about this, what normally do the ask for?
