The notes for the November 2008 Visa Bulletin said the following:

D. EMPLOYMENT VISA AVAILABILITY

The level of demand being received from Citizenship and Immigration Services (CIS) Offices indicates that they have a significant amount of cases with priority dates that are earlier than the established cut-offs. This is likely to result in slow forward movement of the cut-off dates for most Employment categories during the next few months. Sudden changes in the CIS demand patterns could result in fluctuations in the monthly cut-off dates, and retrogressions cannot be ruled during FY-2009.

    Question: Merger or acquisition

    Hi, currently I am working with Company A on H1-b visa since last 3 yrs and my GC process is also on the way with Company A. LC approved, 140 approved, but didn’t apply for 485 as my PD is oct. 2007.

    Now company B bought company A where I am currently working and employed so soon we will be a part of Company B.

    What will happen to my status and green card process? Could anyone please help me out in this situation what will happen to my status and gc process?

    Why the dates of the bulletin are not consistent in OCT 2004 The family related Visa for México where on March 1993 and 4 years later they are on SEPT 1992

    ¿How is this possible? The visa bulletin has no credibility whatsoever.

    Any chance of becoming EB2 current for the month of November? Any guess on the impact of economic crisis on visa bulletin? They say things will be different if Democrate elect, is it true?

    Our priority date Jan 9, 2006. Do you think the Novermber 2008 bulletin could be back to March 2006 as the last priority date before it bacame unavailable before Oct 2008.

    Dudes, I took a Info pass to check on my EAD, during the course of the conversation the officer mentioned I have a good chance of getting current in December 2008, My PD is November 2006 and category is EB2 India, my 140 is approved and Namecheck is cleared. Reason he told was, they found only handful of cases open for PD with 2001-2006.

    Guys, this is the breaking news !!!! They just fired a guy who used to have all the keys for the boxes filled with EB2 and EB3 applications. Now they can’t open those boxes anymore untill they hire some new personel. But with week economy,chances are very slim they said ! Good luck to all and welcome to great year of depression !!! Now any thing is possible !

    the date wht we can see in the bulletin, wht is it means? is it the date wht they r currently processing or it has benn finished. this thing is not clear to me and i don’t know any person who can help me, so can anyone help me out plz?

    Everyone,
    No one knows when date will move forward or retrogress. AT this point its not going to help by asking questions like when and how many years of wait.
    We all can guess but no perfect answer till the bulletin is out.
    Its frustrating for everyone but thats what it is.

    Abul,
    The dates you see on visa bulletin are for applying for I485 (adj of status) if your priority date is before bulletin date. Check with your lawyer for getting your priority date. Normally its date when labor cert is filed.
    It will take few months or years after you apply for I485 to get your final green card. It all depends on what category are you in, how dates change after you apply for I485 etc. Date is just for starting the final steps to get GC.
    Everyone waits for years to get to I485 date and then wait more after they apply.

    I am in EB3 Category and visa interview was held in Oct 2007. It seems name check was done and now pending adjustment of status. I do not know my Priority date. Where should be look for the priority I140 or I 485. Is there any chance this year for the GC ? Thanks

    Look at your I-140 for the priority date. It should be in top left corner of the I-140.

    If you are still confused it is the date you filed your labor certificate. The very first date that you sumbitted your labour certificate.

    August 2005 nurse will be processed first, and stop there. Hope those of you pinoys who are cheating by using adjustment of status from your tourist visas to cut in front of us waiting here in the Philippines NEVER GET YOUR VISAS APPROVED. Hope you will all be denied.

    For India EB-2 and EB-3, only two months moved ahead from October 2008 Visa Bulletin. Very disappointing!!
    For family based categories, the Rest of World shows a snail pace movement. In fact, FB-3 (adult married children of USC) and FB-4 (siblings of USC) have even moved backward.

    good day,why is it that the visa bulletin for EB3 moved back to may2005 when the last time i checked it, its march 2006.why is this happening? my priority date is may2006 so i was devastated that it moved back,i was so close to it.by the way,if ever the priority date will move to may 2006,how many months will i expect to have an interview schedule?pls keep me updated.thank you in advance.have a nice day.

    Mr. John,

    I am currently employed by a company who sponsored me from H3 to H1 in 2006 up to the present time. My problem is the sponsoring company is gradually phasing out the business from Company A to another company of the same business called company B. Because the owners are one and the same, the pay slips were just changed from Company A to company B. This company B has its own name and federal tax id no. My question is, will there be an effect in my papers since the sponsoring company is no longer the one paying us but the other company is? Also, I want to apply for labor cert but since Company A is being slowly phased out, do you think I can still be approved for this company? I hope I can be enlightened.

    Thinking that there is no one left over in EB3 India.No one even considers it as a category anymore.I’m stuck with this category.Any suggestions for a future.Noway to change to EB2.

    Is the Govt planning of making additional number available ? Seems like America is slowly closing its door to immigration.

    EB3 India is moving at such a slow rate that it seems most of the beneficiaries would have to wait 8 -10 years before gettiing a visa number. For anyone applying now it may be quicker to go to canada and then migrate to USA.

    If company A did buy company b , company A is not longer in business. Your paycheck is not showing company A information that is a signal.You need to change your sponsor to get a new paperwork ASAP . Please check it with your lawyer.

    hi, can anyone give their opinion pls..
    im a RN in Philippines. plan to take NCLEX next yr. I was a derivative beneficiary of my dad’s F4 petition (his brother petition him). I am already over 21. There’s the CSPA. I know i have a big chance of retaining my dad’s PD once he’s filed a new I-130 for me. If i make it to the US as an immigrant, do i have to take the english exam like ielts? also, is being a nurse in phils with or without passing the NCLEX–grounds for not being issued an immigrant visa under my dad’s petition? PLEASE, i need ur opinion. thanks!
