I don’t predict any movement for the EB3 category in the May visa bulletin. The numbers jumped forward in the March and April bulletins, and we’ve been told by State Department officials (in visa bulletin notes) and AILA that the movement was an effort to preempt unused numbers at the end of the fiscal year. So my prediction is modest, if any, movement in the EB3 category.
@Paul Kim: I’m not familiar with the “Other Worker” category. The numbers are so limited I wouldn’t expect much movement.

Your earlier comment suggests that the visa numbers have already been reached for this FY if the “preemptive” move has been already satisfied by the two bulletin movements in March and April. Is there a source of info where one can see how many visa numbers have been used so far for each category and what is still available for consumption in the future?

I am not sure why the link I posted has disappeared. All it was was a link to a bulletin board thread to discuss family based immigration issues. Like GARY B noted, information about family based immigration is very limited and the coverage is not nearly as extensive as for employment based immigration. I thought Internet was all about open sharing of information and here I find out that it is censored. If family based immigration is not to be addressed on this website please specify that this is employment-specific discussion and that no links to external boards should be posted here.

Thanks for your patience everyone. I didn’t respond directly to a lot of comments asking for predictions because I knew the May Visa Bulletin would be posted soon and my predictions would be useless.
@MMS: Turns out I was wrong about the EB3 ROW prediction. Your prediction was a lot closer. This is another example of the State Department saying one thing, but doing another.
@Lostboy: There was some movement in the EB3 category (depending on where you’re from). See the main post above for the dates.
@CADude: I don’t know of any source for the actual numbers. Sometime the State Department puts out numbers and AILA picks it up. If I see any numbers, I’ll post them.
@Wuwu: The cutoff dates moved more than you predicted (and a lot farther than I predicted). See dates above.
@Che-Che: I’m happy to say I was wrong and the EB3 dates moved. I hope the movement helped you.
@Gary B: I think that family based visas are overlooked on a lot of visa forums because the forums are usually setup by immigration lawyers and most of those immigration lawyers target employment-based cases. I am guilty of this as well. That said, I appreciate your comment and I’ll do my best to address family-based issues whenever possible.
@AG: Turns out your inside information wasn’t accurate.
@ONM: Very good question, always ask the source of anyone who claims to have inside information (no offense AG).
@Spitzer: EB2 actually moved another month for India/China in the May Visa Bulletin!

John & Everyone, in an attempt to predict when my stepdaughter’s priority date will be current I created a spreadsheet based on 2007 to 2008 showing the days the PD advanced each month for FB-1 in Europe. The days advanced were as follows; 2007 Feb 9, Mar 0, Apr 7, May 7, Jun 16, July 30, Aug 38, Sept 53, Oct 37, Nov 30, Dec 31, 2008 Jan 24, Feb 7, Mar 7, Apr 7, May 15. OBVIOUSLY, the priority dates in 2007 advanced rapidly from June to Jan. I don’t know if the pattern will hold true, but it should give hope to those who only see one day or one week advances. Check your own classification and area to compare.

I’m so happy that there’s movement in the EB3 for the Philippines despite all the predictions that there wouldn’t be. But I’m so afraid that the movement will stop short of my PD (June 2007, but it’s already approved and with the NVC). Does anyone think my PD has a chance of becoming current this year?

I think we are going to see about the same situation as last July. As it was curent for all in july so there must not be many left how didn’t file for I-485 with PD earlier than april or may 2007. So USCIS should not be reciving a whole lot of application untill the PD will become some where around June 2007. I strongly belive that the PD will aleast go until end of Dec 2007 for FY 2008.

hello john, I am an RN & my PD is august24,2005 eb3 Philippines. Why is it that until now my friends and I with the same PD have not been interviewed or even scheduled to be interviewed yet? the may visa bulletin shows that there is availability of visa until march 1,2006. i had emailed NVC & they replied that i am eligible for futher processing & that they will send instructions to my petitioner or the lawyer of record but until now there is no news yet in our case. thanx so much john, God bless you more & more…

hi jen..nope i havent been approved yet. as i checked on the nebraska service center, they are still processing february 28, 2007. mine is may 9, 2007 stated on the receipt notice. have u been approved already? I guess nebraska is quite slow on processing the papers on their center.

John, I’m so pleased about the May Visa bulletin! My PD is Jan. 06 so I’m keeping my fingers crossed that I’ll be seeing my GC soon.
Is it true that in order for your GC to be approved you must first be over the 180 day name check policy (which I am), you must be within processing time (which I’m not, my RD is Aug. 07) and your PD must be current (which i am)?
So does this mean that I have to wait for the April processing time to come out and see if I’m within processing time in order for my GC to be approved?

Another question, I’m EB3 ROW with PD December 2003 waiting for consular processing for me and my wife (no kids so far) with both DS-230 already sent.
What happens if I want to start growing my family before I get the Green Card? If the child is born before my interview will I be able to include him/her when I get the Green Card and he/she will also receive it? If not (can’t be included in my current process), what’s the scenario for the child? Can he/she move with me? then what?

Hi Edz… I read your comment and I just want to clear up things that your PD is Aug. 2005, the last VB was only until July 05, so your PD that time was not yet current, but now, on the May VB, it is because it’s already current now, expect to ahve your interview maybe by this coming months.

last question john, as i read back on the visa bulletins last year pertaining on EB3 philippines, i observed that the availability of visas are not consistent..example:
may 2007 for EB3 phil: 01AUG03
june 2007 for Eb3 phil: 01JUN05
july 2007 for EB3 phil: Current
august 2007 ebr phil: unavailable
september 2007 eb3phil: 01AUG02
october 2007 ebr3 phil: 01AUG02
and now basing back on the bulletins we have now, we are nearing to 2007 PD’s. should we be worried that the PDs could regress back to unavailability or go backward for 2 years? i hope not..or the consular office had already solved the problem..thank you so much..

I am from Malaysia. Received a letter from National Visa Center informed - my priority date is Feb 13 2006.
I am wondering how long I have to wait for my case. By checking on the Visa Bulletin every month, the progress of the processing for the category F4 is tremendously slow.

Legislation to recapture unused visas for H1 and EB categories from previous fiscal years has been introduced in the Senate. It’s called GLOBAL COMPETITIVENESS ACT OF 2008. Let’s all hope it will be passed by the US Senate and the US Congress in turn. Here’s a link to the provisions of the bill.

Hi John! I’m a pharmacist in VA right now and I have a PD of December 2006. I’m curious about how PERM will affect the movement of priority dates in the future. I know sometime in 2006 (correct me if I’m wrong), regular processing was discontinued and PERM was the only option. I wonder if that would impact the number of visas available from hereon…

I posted a question before, I have an approved I-140 with wrong priority date. The priority date on that I-140 is August 2005. The correct priority date should be Aug. 2004. In july 2007 when EB visa is current my lawyer advise to file for a new I-140 concurrent with I-485. Now that the visa bulletin for May 2008 has a priority date of March 2006 EB3 Philippines. Is it ok to apply for a new I-485 using the old approve I-140. Would there be problems if I do this.

Hello! I’m in eb3 category world wide, consular processing (I’m not in the US) and my PD is September, 2005. Last year in July I received the package nr 3 to send the ds and copy of passport, etc. After the date was unavailable, I got my package back with all the documents and a letter that says there is no visa available. Is anyone knows how long time I have to wait until get package nr 3 again and what are the steps that I must to follow? Have any idea when I can come back to US?? Hi john, My PD is Aug, 2005 EB3 Phil . I am very confused right now. I have emailed NVC of my status and they replied as of now that they are still waiting for my DS230. When in fact I have passed my Ds 230 & of my dependents with all the requirements on November 2006 and in july 2007 I have passed another Ds230 with all the requirements because NVC requested for an update. Then why is it that they are telling me that they are still waiting for my DS230. Could it be that they have lost all the documents I sent to them? And if I passed will I wait for some more like eternity again… Thanks so much John I will wait for your reply.

My pd is on may 9, 2007. and i saw your thread that eb3 is on july. 11, 2007 under the application to register permanent residence or to adjust status. at the classification of employment based classification.
my receipt notice says that my section is skilled worker or professional..or those who have already been approved and the status need to be adjusted is totally different from my petition?

I’m in a similar situation as you are. My PD is July 08, 2005 and my NVC was July 2, 2007, but the online status shows august 10, 2007. I think they just made a mistake in the online status. I think we might get lucky in May and get our permanent residency.

che-che, if your 140 is already approved you should be looking at the adjustment of status dates (485). Your PD is still not current as of the last Visa Bulletin but check your RD (receipt date) to see if it’s within processing times. you still have to wait for your PD to be current though. hope this helps.

I called the NVC yesterday and it says that..the office is waiting to submit the beneficiary biographic data to continue the processing of the file…what does this message means? Thank you!

Hi John, thanks for your comment, painful to hear but have to face the reality of things. Anyway, H.R. 5882 was introduced last week by Reps. Lofgren and Sensenbrenner to recapture an estimated 218,000 unused EB green cards. It’s said that it has bipartisan support and has a better chance of being passed by legislation than previous bills. If it does get the thumbs up, it will take effect in the following fiscal year which will start Oct. 1, 2008. How do you think the last four visa bulletin’s of the current fiscal year will be affected or potentially be affected by this? Thanks again.

hi john,
i have seen sudden advancement in the priority dates recently.I remember in the past dates have gone in the opposite direction.what is the chance of that happening again?i am not very optimistic given their recent track record and looking at the recent rates of change in the pd over the last few years, looks like a good 8-9 year wait till i actually get the gc.

thanks so much for all the work you put into helping us poor lost non-american souls!
I am over 21, unmarried and a German citizen; my father is a green card holder, but he is eligible for US citizenship (and I could probably convince him to take it; though he has some reason to prefer not to do so..)
I guess this currently places me in category 2B of family-related immigration, though I could be upgraded to 2A if my father got citizenship.
3 questions: a) do you have *any* kind of reasonable guess - and I realise this is extremely provisional - of when I could expect a green card from the two respective categories?
b) I’m in the first year of a PhD program on a F-1 visa, which will keep me busy for at least the next 5 years. Could a pending green card application have any adverse consequences on my F-1?
c) I might want to spend one year of my PhD program at a different institutions in the US, for which there’s a formal exchange program from my current university. Would that require me to get a new F-1? If so, might that be complicated by a pending green card applic?

Hi John, I was wondering if you know the procedure to withdraw an EB3 petition from the USCIS? I checked the status of my application and it said its in “consular processing” which I basically do not know what stage that is
My PD is July 2006. I was also wondering if it is possible to TRANSFER an EB3 petition (my PD) to my new H1 employer? Thanks for taking time to read this and I hope for your response
