  Hello John,
  My priority date has been current for months. I’m way out of processing time since my I-485 receipt date is from 2004 (I’m EB3 ROW). I took an infopass and was told my background check had been approved. However nothing has happened at all.
  My priority date is wrong. Somebody at USCIS mistyped it and it shows as November 13, 2004 instead of January 13, 2004. What should I do to get it fixed? I called USCIS and they said they didn’t know how to fix it. I got the same answer at the Infopass.

  My petition has been returned to USCIS (dont know for what reasons) - my agency told me its probably because of my family bec it’s a Mexican name and it went back for name check/background check. Has this been your case? How long long did it take to process yours? My PD was also current last visa bulletin :(. Im also under EB3 status. Pls advise.

  Hi Emilia,

  As far as i know, fiscal year for 2008 ends until september 30th ( but acording to nvc all visa for the 2008 fiscal yr had reach its limit. The new fiscal year for 2009 will resume on the 1st of october… Hope this enlightens you! God bless for all of us waiting in agony!

  how can we know that still indian quota is open for F3 category
  As per guildline before 6 months of availability of priority date visa relevant documents are being sent to the migrant i.e. before priority date became a current -prior to that (6months before docs are start receving by applicant )
  Appreicate is any one can help us to know the exact procedure for both questions

  Does anyone have any idea on future movement for FB-1 rest of world? PLEASE! My date is April 1, 2002 and this just is taking so long. The worst part is that the whole process is not transparent. We are waiting in the dark with no indication as to what can be expected over coming months/years.

  Hi.

  Our priority date is Nov. 20, 2003 (under EB3, Philippines). We had our interview last April 21, 2008 in the Embassy in Manila, and were informed that our papers were in order and our visa was approved. It has been 7 weeks since the interview, and the Embassy says it is still “in process”. No additional documents were required from us.

  With EB3 becoming “Unavailable” this July, does this mean we will again have to wait until October (hopefully) assuming our visas are not released this month? Is there any way around this?

  What category were they under? I think that those with fiancee visas are processed rather quickly. Might also depend on priority dates, etc.. All guesses, though. No one really seems to know what happens once our papers are submitted. Thanks.

  @Mel: Unless the EB3 visa is released in June, it won’t happen until the next fiscal year in October 2008.

  @Blandine: I always fix receipt errors as soon as the receipt notice is issued. Why did you wait 4 years to correct the error?

  @Falgun: The Indian quota is not showing a “U” for unavailable.

  @Rayon: It’s possible in June.

  @Clifford: The priority date must be before the cutoff date for the visa category.

  @Nancy Innes: Assuming EB3…then no. Only in June. EB3 is unavailable in July and, presumably, August and September visa bulletins.

  @Lesley Anne: Unavailable. =(

  @David: Complicated question. You might want to consult an immigration lawyer.

  @David 2: Unless the visa is issued in June, you might have to wait until October.

  @Madel: There are likely some visas available to be distributed in June. EB3 visas are unavailable in July and onward (until the new fiscal year starts in October 2008). Please let us know what happens when you go back to the consulate… I’m sure we’d all like to know how it goes. Good luck!

  Thansk for your reply . That means F3 Category for India is still available for Finacial year Ending on OCtober 2008 . Last Three month pd is not moving from 8/6/2000 and my one is 10/10/2000. Should i expect any letter from Visa office in advance. Some category they are receving letter and documents before their prioirty date became current — 3 months advance (priori to their po date became current)

  Once ur files are documentarily qualified from NVC the embassy where u reside will schedule for an interview. I would advise if ur not a nclex passer, make it as soon as possilbe. U will never know the decision of the consul. Gudluck and hope this will enlightened u

  Hi there! Based on the july vb, the unavailability of immigrant visas only applies for EB3 and F2 phils and not F1. For your category i do believe that its already been current coz the Vb under ur category is now March 15, 2003. Do u have a lawyer there? You should follow it up b’coz ur suppose to have an update by now w/regards to your status adjustment. Your PD is far too long from the latest Pd. You have to verify it at your lawyer or NVC. They might overlook your status . Good luck and God bless!

  i also have some question about the validity of my nclec,i passed it may2006,i recieved a letter from the california board of nurses that i need to submit ssn within 3 years after passing it is already 2 years and 1month to be exact im afraid that il lose its validity before il be able to leave the philippines to go to the us to get my ssn.is there anyway for me to handle this case.thank you so much again.God bless

  Leon. it depends what your status is, tourist of student. Some student visas have no specific time limit, but I would talk to a lawyer first.

  Dear ria,

  They based the PD from the time when they started filing your petition. But when did it was approved? Did your lawyer informed u that your petition has been approved? If yes, INS will forward your papers to NVC then NVC will review your case and they will send your lawyer the packet 3 w/c includes your DS forms and other needed requirements. But sometimes lawyer (like mine) inform clients ahead of time to provide them the documents that should be submitted together w/ the DS Forms. Your lawyer should be the one to update you for that. Unless your case is still at INS. Hope this help you ria. Good luck! Ciao…

  My father apply for me in august/2000. My p.d is aug/22/2000.
  Me and my wife are canadian citizen(both born in india)
  We have one son born in u.s.a(premature born while visiting my parents)

  I have received(june/1/08) and sent(june/2/08) ds-3032(choice of agent)and i864 fee.
  nvc received and generate iv bill(ds-230 bill) on june/9/08.

  my question is after genarating iv bill how long it will take to recive ds-230?
  when will nvc send i864 to my parents in u.s.a.?

  My whole family immigrated in the US 6 years ago. I was originally included in the petition, but because of long processing time I was not able to come because I was already 22 the time we received the notice for interview.

  My mom who is a Permanent Resident petitioned me 5 years ago, my Priority Date is 12JUL2003. I havent heard any update reagarding the status of my petition. I heard from a friend that if you were petitioned before but was dropped because of age limit when a parent petition you it will only take 5 years before i can be issued a visa and not 11 years. Is there truth to this, is there a special consideration for my case?

I want to know what is your status when you go there? Right now NVC’s priority date was until March 2003, that was under philippines. You also mentioned that yours is May 2002. By the way in regard to your question, my case was filed here in the US. So I was hoping to adjust status … but I may end up going back to Europe as my OPT nears its end date. (My PD is in May 02)

  I recently went for an interview with the USCIS New York City District Office for my I-485 employment-based application. I am under EB3 and my PD is October 20, 2006. The lady who interviewed me was in her late 20s. She was nice. She asked for my birth certificate, latest employment certification, driver’s license and passport. She skimmed through almost every page of my passport. She took my I-94 and she said I’m not gonna need it anyway. She asked me questions such as arrest, espionage, overthrowing the government, etc. etc.

  Then she took a look at my G-325A and she said it must be updated. She asked me to go to the 1st floor of the building and asked me to fill it up completely and return it as soon as possible. I gave her my new G-325A and she asked me if I am willing to wait for my VISA stamp. She made me wait for almost 30 minutes only to find out that EB3 is currently “U”. She explained to me politely that I should keep tract of Dept. of State’s VISA bulletin to estimate when will I get my GC. She further told me that, I should just wait for my GC on the mail as soon as priority dates becomes “C”.

  It was a nice but nerve-wrecking experience though.

  I am guessing you are on an F 1 student visa right now. With OPT time expiring soon.
  See a lawyer. From what I know if you are doing consular processing you should be ok. If you are doing adjustment, that is another thing i don’t know about that. It depends on what your I/94 says, if it has a date or D/S. D/S is good for you, if you have a date and that date expires soon I suggest you return and wait for you PD to become current. See a lawyer.

  Thanks so much for the advice. By the way … I never heard of that I-94 thing. I’m pretty sure it says D/S on it. What is that? I’ll be able to look into that soon and I’ll let you know.

  And yes, my attorney has told me we will do adjustment of status. But we will see how things develop with the PDs. I’ll keep you guys informed when I learn something new!

  Of course, the easiest thing will be when the PD hits June, then both you and I won’t need to worry about PDs anymore! We better be lucky with that!!!

  LEON;
  adjustment of status will take longer than consular processing in general, however to change at this point might take as much time in the long run. If you are doing adjustment of status you have to maintain status until your adjustment takes place I believe, otherwise you might have some problems with being out of status. I would get a GOOD lawyer if you are planning on staying until PD becomes current. If you want to change to consular processing you have to file some forms for that, then you might be able to stay until PD becomes current. Consult a lawyer even if just once. Expensive, but worth it.

  oh NVC does not deal with AOS, the USCIS does. NVC is only for consular processing from what I understand. If you are dealing with NVC then you must be in consular processing.

  good day, i like to ask a question regarding our case. We, my husband and i were interviewed last june 25, the consul said that everything seems ok but they cannot issue us visa ‘coz it is unavailable due to retrogression. They said that we should wait till october, and held our papers so that they can deliver our passports with our visas when it becomes available. My query regarding this matter is that, is it still possible that they can issue us visas before october? are there circumstances (like trough recaptured visas? etc.) that they process papers even though it is not yet the the beginning of the fiscal year?

  My PD is January 10th 2003. My lawyer Korenberg is currently in trouble. His cases are under investigation though the alligations are against him are due to the employees he hired for his firm. I am thinking of changing my lawyer. I am under E3 category and filed my I485 in May 2007. I got my work authirization in August 2007 for one year. Please someone please let me know your views. I am very upset about the situation. Other lawyers in his firm are not at all helpful.

  Hi John…my PD is July06. I am one of those anticipating good news come Sept-Oct BV. While waiting, I had applied in Vermont so I can take NCLEX hopefully before the year ends. It’s better to take a move ahead before hearing from the Consul reasons for holding issuance of our visa come our turn soon.

  so we went on june 19 as told and right then unexpectedly we went through finger printing, they scan through the documents and had the interview. i passed the cspa computation. thank you lord!

  then we were told by the kind hearted consul to submit the medical and some documents from our petitioner. we got it all done and submitted by june 26th.

  it`s been 2 weeks already but we havent gotten a respond. iv texted the delbros hotline but they havent received anything from the embassy.

  whats likely to happen now? i thought it would be just days then voila here comes the visa, but it hasnt come yet. we should just be patient about it and continue to pray for it.

  For the Family-Based Visa Bulletin, if I am from El Salvador, what category do I belong in, i.e., Mexico, All Charge- ability Areas Except Those Listed, CHINA-mainland born, etc.?
