D. INDIA EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY
Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual “per-country” limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.

Maybe I am over optimistic.. This is just a hunch! I am just looking at last year (2007) progress and predicting something similar

I don’t think retrogression will be lifted in the April visa bulletin. I don’t even think retrogression will be lifted in 2008.
The jump forward in the March bulletin for EB3 was a preemptive move by DOS/USCIS, in my opinion.

Hi, I am new to this site and the title ‘visa bulletin prediction’ sound strange to me after my internet surfing reveals that visa bulletin can not be predicted. any way, a person like me who is waiting for visa bulletin every month will be eager to know even the most casual prediction. Since the title say visa bulletin prediction so I would like to know how is FB1 category predicted to move in coming 1 year. Do you thing that I would moved 8-9 months in an year time.

@Chachu: Hi. I completely agree with you that the visa bulletin cannot be predicted. If you stick around here long enough, you’ll find that I am a broken record saying no one can predict the visa bulletin - not even the people running it.
That said, sometimes there are hints at future movement in the notes of the visa bulletin itself. See the March bulletin. The notes of the March bulletin explained why EB3 dates jumped forward so dramatically and emphasized that dates might slow or stop in future bulletins. Those notes, in addition to postings I’ve read on the AILA website, are what gave me some confidence in making my prediction (read guess).
But I really have no idea about how far F1 might move in the next year, particularly when you haven’t told me where you’re from. Best we can do is monitor the bulletin each month and see what happens. I hope you’ll come back here to check!

Hi John. I guess it’s not bad to optimistic when you have been waiting endlessly for your interview date for the longest time when the other sgot to the US in less than 18 months. I always surf the internet for all the opinions and declarations of almost all Immigrant lawyers and some of them are quite positive.
Although yes, no one can predict the VB movement, even the president of US, it’s not a sin to dream and to give some of your supporters a glimpse of something to look forward to. I’m under EB3 category and my PD is July 2006, Philippines.

Thanks for the elaboration. I am in FB1 (rest of the world) of unmarried son and daughter of US citizen with a PD of Oct 2002. I want to know if there is any possibility that my PD could be reached in an year time. FB1 is higly oversbuscribed and it did really bad in past 3-4 years, but showed some movement untill Jan bulletin and then slowed down again. Its really frustrating for every one who is waiting for so long. can you make a guess about FB1 for rest of the world.

I think the EB3 ROW category will move forward in April by a couple of months to April, 2005. Eb2 for India is unavailable and Eb3 India will become U, due to 7% of quote being reached in march ( new name check memo will make a lot of Eb3 India eligible), being EB2 and Eb3 India out of combat and China close to reach 7%, the universe of pending applications eligible for approval will be= ROW+ Mexico+Phillipines- China -India, which would represent a substantial decrease…I truly believe the demand from ROW countries is much less than what USCIS and DOS believe it is

In your response to Vik’s comment you said “…I don’t see it happening in the next 12 months” I am assuming you said this because he mentioned India. But if one were from any other part of the world (not China or Philippines) would this 01 Jan 2005 cut off mean that a people whose PD is before or on 01/01/05 can file I-485? I see its a major jump, do these dates ever go in the backward direction?
Sorry for the basic question, just new to this process and trying to figure out the technicalities behind the (so-called) system.

@Chachu: I really don’t know how long it will take for the cutoff date in your category to catch up with your priority date. I hope things change in your favor.
@Siva: I am not optimistic about immigration relief for Indian nurses. But other lawyers are, so who knows. I don’t know of any significant movements going on right now, but I will post announcements to this blog if I hear anything.

@MMS: You are exactly right about the relationship between the cutoff date in a visa preference category and the priority date of individual applicants.
And, yes, the cutoff dates can and do go backwards. Sometimes a category will be marked with a “U”, indicating there are currently no visas available - see the employment-based second preference (EB2) for nationals of India in the March bulletin.
It might seem like a basic question, but it’s fundamentally important to how the visa bulletin works. Thanks for asking.

Fb4(rest of the world) was moving at a very fast rate around mid last year and then it later on slowed down. In Feb this year, it didnt move at all! and then in march, it only moved 7 days. My PD is sept 2007 and right now they are still in July 2007. we were expecting it be current since last year because of the fast movement, but now it seems to take forever. Can anyone predict how far Fb4 will move in April and how soon my PD is likely to be reached?

@Moi: I wouldn’t want to guess with just a few more days until the April bulletin is out. Check back soon. That prediction might be a little optimistic…
@Clara: The NCLEX is something I’m not very familiar with.. I’ve only filed nurse petitions where the applicant had completed everything. Maybe someone else has been in the same situation and can help her?
@Rachelle: I just looked at the last few visa bulletins at the F3 preference, and you aren’t kidding. It hasn’t moved at all in recent bulletins. Hopefully the April visa bulletin will break the pattern. Your MySpace page might have some mutant code in it - it crashed my browser!
@Ray: Where are you from?
@Bong: Hi. You should keep an eye on the April visa bulletin and the processing times over at USCIS. See USCIS processing times. Check your receipt notices for the receipt date, and crosscheck that with the current USCIS processing date (using the link I provided).
@Jess: I have no guess on family 2A preference. Are you Ols?
@MLGL: The cutoff date is 15 July 1992 for your category (family-based 3rd preference for nationals of Mexico). Unfortunately, it’s impossible to predict that far into the future. April bulletin is out very soon.
@KB: EB2 India is a tough one. If numbers do become available in the April visa bulletin for EB2 India (notes of a previous bulletin said some visa number might be made available in the second half of the fiscal year, which is the April bulletin), I don’t think the cutoff date has any chance of catching up with your priority date (November 2006 EB2 India). It is possible.. But my prediction is that there will be no real movement in India EB2 until the next fiscal year (October 2008). And, even then, the movement might not be very significant. Did you have a specific question about AC21?

I know that the April bulletin is expected soon, but it will take a miracle to witness a jump from Aug 2001 to june 2003 (my PD) this month, given how slow the movement has been in the past 6 months. Still, how do you see the movement of EB3 India, going forward? We would really appreciate a realistic estimate of when our PD of June 2003 might become current? Do you see this happening by Feb- March 2009? I know that it is impossible to predict trends accurately, just give us your best and worst estimate. Getting impatient because of a position I’m anticipating.

Good day! I’m in the EB3 category and my PD is January 10,2005. Do you think that the Visa Bulletin this April would at least move forward and reached my PD? And if ever it will move a liitle bit further and cover up my PD would that mean that I will finally get my visa? I had my interview at the U.S. Embassy last May,2006 but I was not given a visa because my documents was still incomplete at that time. Last August 1,2007 I completely submitted all the required documents but unfortunately because of unavailability of visa numbers I was not again given the visa. After the very long wait will I finally get my visa soon?

@Lostboy: Thanks for your comment. The cutoff date for EB3 India in the March bulletin was August 1, 2001. It didn’t jump forward with Philippines and ROW. And I don’t expect it to move forward very much, if at all, in the upcoming visa bulletins. Again, hopefully I’m wrong.
@Edz: Not at all. Maybe indirectly because it is difficult for Congress to get anything done during a time of excessive politicking. But the visa numbers are predetermined.
@Sim: I’m not sure. The April visa bulletin should be out any day now - maybe it will tell us more.
@KB: What does “skipped three jobs” mean? So long as each change of employment was valid, there is no overall limit on “hops”.
@ONM: I sincerely appreciate your impatience. Believe me when I tell you that I am sympathetic. I worked at an immigration law firm after graduating from college, and nearly all of the applications I filed (mostly EB3 Indian applications in 2001) are still pending. I can’t imagine having to wait that long for something so important. Unfortunately, I don’t predict very much progress (if any) in EB3 India in the coming months. Like you said, though, the April bulletin will be out soon and maybe it will tell us more. I have no idea when the cutoff date will catch up to your priority date.
@RIDO: My prediction is very little movement (if any) for EB3 ROW in the April visa bulletin. I don’t know when your priority date will be current. There might not be very much movement after the April bulletin either.

Should I be optimistic about about my priority date being reached anytime in the near future. I am in the F1 rest of the world category. Based on the the VB on the website above (entry 64), at the current rate my Sept. 2003 PD will not be reached until 7 yrs have passed. That would put my wait time at 12 yrs.
When my father filed, we were told it would take about 5yrs.
Am I correct in assuming it could take that long?

“provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.”

I’ve moderated a lot of comments (meaning I blocked them) because everyone is linking to what they thought was the April visa bulletin. That link is dead and you can’t see the bulletin. It looks like the State Department might be having some technical issues. Anyways, the best I have seen is the link posted by Matt (first) and MMS. I’m going to hold off posting anything more until I see something more official.

Hi John, if this will be the official VB for April, 2008– it’s a good news for EB3 category. Can we say that in the following bulletins it will move 5-6 months evry month? Is it safe to say that we are looking at June or July 2008 that the VB cut 0ff date in EB3 will be August 2006?
It’s a relief that the dates did move rather than a standstill.

Ive been surfing @ u’r site 4 quite some time now, been reading all d comments & ur straight forward replies from all d queries. Im an RN from Phils., fall under eb3 w/ sept 01, 2005 P.D. I myself is also an hopeful spectator of the visa updates every month. My question is this, ive hired an immigrant lawyer based their @ San francisco to do all the petition process & everything for me & my husbands behalf, hoping that it will be more easy & accessible & faster for me.. I had give her special power of Atty as well, & paid her in full last 2006, i had given her all the fees needed including our visa fees. But sad to say, since last year july retrogression i haven’t heard from her. Whenever i emailed her she doesnt reply unless i need to call her via long distance & she told me the same answer, that she cant do anything about it anymore coz y pd hasnt been updated yet at nvc. Just wanna know if that immigrant lawyer is still responsible to inform me of any updates thats been going on since i still haven’t receive my packet 4. Does her job ends after im done w/ my packet 3 requirements? Im kinda worried coz im not so sure if she really process everything in my behalf. Where could i check if i want to know if my papers is really at NVC? Who will send my packet 4? Is it the immigrant lawyer or the NVC directly? Hope to hear from you soon john… Thank u in advance!

For EB3 R.O.W, what do you predict will happen to the dates?
One of the theories is that all visas will be pooled together , like last year and there will be a big jump in the EB3. Doubt that DOS will make it ‘C’ but could push dates up to July 2006 or even further.

I am in the catogory of EB3, Mexico. Do you think it will ever reach july 1995? I checked it last year before december and it was in 1994 but now it’s stuck in 1992. I have no idea why. Can someone explain why?

John, I am not looking for a prediction, but I would like your opinion as to why there appears to be a major slowdown for most family based visas? The note at the bottom of the December bulletin stated, “Family Preferences - Worldwide: Movement consistent with that of recent months can be expected for the foreseeable future.” From that point on a majority of the FB classes have slowed to one week per month. I can understand one class being oversubscribed, but it appears the State Department is making a determined effort to halt FB immigration.

The is no law yet to abolish family immigration but a number of senators are pushing for it. It was amazing for me to hear arguments about cancelling FB1, that a child over 21 is an adult and should not benefit from parents’ application. The senatot brought up an example of his daughter in her 20s who lives independently in New York and even if she lived abroad they would visit each other and it is not necssary for them to live in the same country etc. Listen to the hearing if you get a chance. It was an eye opener for me.
Family immigration issues are not getting any attention now since all efforts are on the border fence, on employment immigration and reducing 1,000,000 N400 backlog.

john, is it ok if we will apply for K3 visa while my paper for EB3 is on the process? i have now my receipt notice and my petition is still in Nebraska service center. I was told that there is only 1 petition per 1 person. I had already a contract with my agency as they apply for my immigrant status, I don’t want to have problems with USCIS or DOS for that matter. We would like to get married but as much as possible, i don’t want to have problems with the law or even delayed more my papers. should i wait for petition with EB3? or could we get married and not have problems in regards with 2 petition..please enlighten me on this. My priority date is Aug 2004 and I had my I-140 in March 2007 and applied for I-485 in June 2007. I’m in the EB3 employment based category. I’m a british citizen. I just noticed from the march 2008 bulletin that the employment based EB3 category for “all chargeability areas” has moved to Jan 2005.
When do you think I will receive my green card?

Hi John, I think the Congress should end per country limits since they result in dramatic disparities in the way immigrants are treated based on where they happened to have been born as opposed to the benefits they provide America.
I have an interesting thought. I think we need to hire lobbyists to do some work at Washington if we want anything to happen.
I am not sure this will be legal. Is it possible for you or someone else to set up a contribution web site to gather donations, and use those donations to hire lobbyist? There are definitely cases they can make for lifting the per country limit. The current system tremendously reduce the competitiveness of US citizens in the job market. American employers will favor Chinese/Indian job candidates over equally competent US citizen because they know they can retain immigrants with much lower salaries over long term, since Chinese/Indian employee can’t change jobs for almost a decade after they get hired if they want a green card, even if they are in the EB2 category.
If this is feasible, I believe there will be no problem to raise 8 to 9 millions within a couple months, given the desperations and anger of many Chinese/Indian born professionals who have been waited for almost a decade for the green card.
The only thing is, I am not sure the legal system here will allow lobbyist taking money from non-us citizen to lobby in Washington.

@Lorelie: You might be confusing the processing time at the service center with the visa bulletin. It is the priority date of the applicant, subject to the cutoff date for the visa bulletin (published by the State Department), that determines whether a visa number is available.
@Wuwu: Hi and thanks for your comment. The difficulties will depend on your individual situation. You are presumed to have immigrant intent, by statute, when applying for a nonimmigrant visa. And that presumption must be overcome by evidence on your part.

Have you been provided copies of everything, including your receipt notices? Your receipts seem like the best way to verify that your case is where it’s meant to be.

Regarding the fund-raising for (employment-based immigration) lobbyists, there are already organizations doing exactly this. The American Immigration Lawyers Association is probably the most well-known. Immigration Voice made the news for its rallies and seems to be enjoying some momentum. But there are also smaller units that are active on this, from groups of businesses and immigration lawyers to individuals.
I hadn’t thought of fund-raising on this site. My goal at this point is just to get as much immigration-related information to everyone as quickly and easily as possible. But if enough people visit, it could be used for a lot of different things.

NVC still have yet to inform me if i could now send my police certification to them. (my last remaining requirement ). Last year, I already submitted this but they sent it back sayin that there was no available visa # yet for me (retrogression ) and would just inform me
on when can i send back the said document.Im a little bit worried coz until now no notifications yet from them, i dont want this to cause a delay on my visa processing since my priority date ( dec2005 ) is fast approaching. What should i do? Please help. Thank you so much.

I’m EB3 Phils. filed my 1-40 & I-485 concurrently in July 2007. Also, I have a previously approved I-140 with incorrect priority date of Aug 2005, based on the Orig LC. My lawyer asked for correction of the PD which Sept. 2004. The correction was done in June 2007. My lawyer has advised me to file for a new I-140 to avoid confusion thus a new filing was done concurrently in July 2007. Will this affect my case, maybe slow the processing because of this issue? my PD is now current.

@Ida: This is really a question for your lawyer. S/he probably knows all the facts and can give you specific advice. All I can tell you is that once your immigrant petition is approved, it is your priority date that determines whether a visa number is available.

We have decided to wait until the immigration interview to go ahead with any lawyers. In essence we really wouldn’t be able to do anything, because it will all depend on the immigration officer here in Brazil. But I will keep you posted.

A million thanks 4 providing me an info of how & where to check about my status for my eb3 (RN phils). FYI, i did receive all the necessary documents w/ the corresponding receipts before, since the start of my application until my packet 3 was sent to me. That was last september if i remember. Then d immigrant lawyer told me that my packet 4 will be coming very2x soon that time. but retrogression took place last july. Since that time i havent heard or receive anything from here anymore. I did try to asked her for a couple of more months after july, but all she said was that she doesnt have anything to update me coz its not anymore in her hands w/regards to the retrogression. And that my packet 3 was already @ the NVC. Is she right with that john? Anyway, one more query john, do u think my PD ( sept 01, 2005) will be included on May bulletin if this is how the VB goes on? And if so, do u think we will wait for the next month bulletin or we will just ignore that movement. You know i am planning to leave philippines for work & it will took me a year to come back again if ill accept the offer. I am confused if ill just wait for my visa instead. Pls enlighten me john. Applied for GC thro emp, in CA in 2003 in EB3. Labor approved with PD of Oct-2003. (Do not know if I-140 was filed and or approved…)
Moved to MI for the same employer, different role. Re-apped in EB2; PD for this is Nov 2005. LC and I-140 approved. 485 filed.
My question is, can i re-use the Oct-2003 PD now? Does this depend on whether the I-140 was approved for the previous application?

@Chas: Hi. Is your friend in the same category as you? You mentioned in your earlier comment that you are EB3 Philippines. But the priority date you mentioned for your friend (February 2006) is after the cutoff date for EB3 Philippines. Is your friend possibly in the EB2 category?

@Hiba: The temporary work card (Employment Authorization Document or EAD) is applied for at the time of filing the I-485 (I’m assuming you are here in the US). If your priority date is not current, you cannot file the I-485.

@Minakshi: Thanks for reading and commenting. You’ve asked a good question and you’re correct that the answer depends on whether the I-140 was approved on the prior application. You can only maintain the earlier priority date if the initial I-140 was approved. For anyone interested in the regulation governing the retention of priority dates, see 8 CFR 204.5(e). I’ve realized that there are actually quite a few immigration lawyers reading this blog, so I’ll try including citations in my answers when it makes sense.
@Carlos: Hi. The cutoff date in your category has only moved about 6 weeks since the December bulletin. Your priority date is still about 8 or 9 weeks after the cutoff date in the April bulletin. I hope that helps.
@Barbs Dee: It’s impossible to say. But I would definitely keep an eye out in the mail for correspondence from USCIS. Make sure you’ve kept your address up-to-date. Good luck, and please let us know when you hear anything because I’m sure others would be happy to hear about your experience.

@PVV: See my comment on retrogression here. Also, my hunch is that the folks at the State Department and USCIS are getting better at keeping track of the numbers. I have a question about the Automatic conversion clause of CSPA.
Based on the CSPA quote below:
Quote from Section 3 of CSPA law:
“Retention of Priority Date – If the age of an alien is determined under paragraph (1) to be 21 years of age or older for the purposes of subsections (a)(2)(A) and (d), the alien’s petition shall automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt of the original petition.”
The question is, in an F4 category case, how does USICS apply or interpret the automatic conversion aspect? When it says the “petition shall automatically be converted”, does that mean that the beneficiary will not need to file a new 1-130 for the derivitive who has aged out? Does that mean that the derivative who has aged out will be able to adjust status with the beneficiary (assuming the priority date of the appropriate category is current)? Or will the derivative have to wait until the beneficiary’s permanent resident application is approved, and then have a new 1-130 filed on his behalf and then ask to retain the original priority date? If the latter is the case, that doesn’t sound automatic to me.

I have a I 36O approved since Aug 2004, and have always maintained a deferred status till date. I am syill waiting for my priority date 14th June 2003 to be current, my category is F2A.
I had a H1B, which expired in Dec 2006.

First of all, I would like to thank you for this great service you are providing to all of the US visa aspirants. God bless you. I am going to file for my immigration process thru my company in EB3 category. I am from Kuwait(Currently on H1B in US), My question is that after the labor approval , Is it possible for my company to file for I-140 and I-485/EAD concurrently or not….I understand, I will have to wait for my GC till the PD gets currrent but will I be able to file for an EAD earlier or I will have to wait for PD to get current….I assume that looking at the movements of the EB3(Rest of the world) it will atleast take 4 years or more for my PD(Feb 2008) to get current..What do you reckon ?

I know this may sound very ignorant but i just happened on your site while researching immigration news for a friend. I am su[rised to hear people post that they have priority dates of 2005 and earlier in the EB3. I came into the US sept 2006 under EB 3 category schedule A ( rest of the world) My peition was filed in june 2005 and approved januray 2006. i went for interview and got my visa as late as july only because there was a communication problem between the my agency and the attorney they use on payment of immigrant visa fees. So my question is how come my case was concluded before those that were filed earlier? when retrogression hit and i saw the dates went back to 2002 or so i
