My son-in-law works in US with HIB visa for a Indian company. My daughter and grand son are with him in H4 visa status. My daughter is now pregnant and due for delivery in mid JULY. My son-in-law’s h1b visa petition rejected two days back. My daughter can not travel now and my son-in-law has to be with her for support.
How can they extend the stay at US legally.
I am in great pressure now. Please give your valuable suggestions and reply

I am from KY, had applied h1b for spouse (currently on H4) wth premium processing. Firstly the agent says it was denied by USCIS and then he filed an appeal against the decision. MY question is before the decision for this is made, can I recall the appeal and get some kind of refund from the agent/USCIS? Also, is it mandatory that all premium app should be decided within 30 days?

@Luis Moreno: Keep in mind that an H-1B "visa" is not the same thing as H-1B "status". An H-1B visa allows a foreign national to apply for entry to the United States. But upon entry, the visa holder enters H-1B status. The date listed on the I-94 is the expiration date of H-1B status.

H-1B status holders generally apply to extend H-1B status before the I-94 card expires. If the extension is granted, the approval notice will have a new I-94 card at the bottom with a new expiration date.

I currently have a valid H-1B visa until 2011, but my I-94 card reads "Until Aug 03 2008' Can I renew or ask for an extension of this I-94 while in the USA? or I must gooutside the country and reenter to get a new I-94 card?

Thanks!
